FOR IMMEDIATE RELEASE:

Federal Trade Commission’s Ban on Noncompetes Opens New Opportunities for Ohio Businesses and Workers

Cleveland, Ohio – April. 24, 2024 – Yesterday, the Federal Trade Commission (FTC) issued a final rule banning noncompetes in the United States, marking a significant shift in employment and competitive practices.

“Ohio businesses are constantly looking for ways to retain amazing employees and attract new talent, “said Jessica Murphy, SVP of Operations at Anderson|Biro Staffing, a leading full-service staffing firm specializing in talent acquisition for the office professional and light industrial sectors. “The termination of noncompetes likely has significant implications for employers and employees alike here in Ohio and beyond.”

The FTC estimates that noncompete agreements affect 18% of U.S. workers—approximately 30 million people—restricting their employment opportunities. The rule will take effect 120 days after its publication in the Federal Register. Employers must notify employees currently bound by noncompetes that these agreements will no longer be enforced. The FTC encourages using established practices such as trade secret laws and non-disclosure agreements (NDAs) to protect sensitive business information without restricting employment mobility.

For businesses where noncompetes were a hurdle to retaining or acquiring talent, Anderson|Biro Staffing offers tailored recruitment services to help companies adapt to this new regulatory environment, developing talent retention and acquisition strategies.

“As businesses and employees are freed from the constraints of noncompetes, Anderson|Biro Staffing is ready to assist Ohio employers in adding the talent they need for their businesses,” said Murphy. “Terminating noncompetes likely brings local talent off the bench and back into the arena, which could be a win for companies that navigate this change most effectively.”
